PNP Check Point Shootout, 1 Dead

Bulanit, Labangan, ZDS – A 16 year old lass was reportedly killed in an allege shootout between a drunk businessman and police operatives of the Labangan PNP Police Office manning a checkpoint who conducted a random checking on all vehicles passing the national highway at Barangay Bulanit, Labangan, this province last February 24, 2009 on or about 7:30 PM.


Nao-nao Poyos Mahinay, 16 years old, female, of Davao City died after suffering a single gunshot wound in her head after police fired in retaliation her ridden KIA Avella Car driven by her brother-in-law who is now under investigation by the police in the allege shootout out that happened.


Police disclosed that the suspect, Nelson Mariscal y Turno, 41 years old, a businessman in profession, married and a resident of Dumalag Aplaya, Matina, Davao City was driving drunk in his car with plate number JCE-817 together with his wife, a certain Rosemarie Mahinay Mariscal, 32 years together with the victim and her two cousins namely: Jennifer Pombo Cagampang, 28 years old, married and Jacinta Mahinay Pombo 31 years old at the back seat of the said vehicle.


Accordingly, the suspect did not break stop in the said checkpoint and fast run against the police, a shot was heard from the suspect’s vehicle that prompt the police to fire back hitting the back of the car unknowingly that the victim was seating at the back seat.


Meantime, witnesses said that while the fast driving vehicle hit an elf cargo truck park along the highway and rammed a passenger van from the opposite direction. This time police manning the checkpoint rush up to the damaged car and apprehended the suspect with his cal. 45 and noticed that one of the passenger was blooded and called for a medical assistance however, the victim transpired before an ambulance arrive.


Police manning the checkpoint called for emergency police assistance from its mother unit, the PNP Provincial Office (PNPPO) and SOCO (scene of the crime operatives) PNP R9 to investigate.


In the SOCO investigation, the suspect’s firearm an ARMSCOR M-1911 cal. 45 was licensed under the firearms licensing unit of the PNP national Headquarters with Firearm Licensing Card control number 1-B610967 and FA License No. 93764111764630 dated January 28, 2009 with expiry date June 27, 2011.


The suspect in the interrogation said that while he has seen the checkpoint he managed to handle the firearm which was placed under his lap to safe keep it but alledgely fired accidentally and made him fast drive against the checkpoint to elude arrest, but he rammed the cargo truck and the passenger van that made him stop.


Meantime, in the police and SOCO further disclosed that, the identity of the suspect divulge from his identification card was a former radio broadcaster of DXOW Davao and as a confidential agent of the AFP particularly with the Philippine Army, with MO number 0-01-035-09-E issued February 9, 2009 up to March 31, 2009 with markings “ALL OVER THE PHILIPINES” issued by a certain LTC Rhoderick M. Parayno (GSC) INF, PA, HEA to the CSAFP (Issuing Authority).


Meanwhile, PNP Provincial Director P/SSUPT Ramon Ochotorena who personally led the investigation together with P/CINSP Alejandro S. Gunao, the OIC COP of the Labangan PNP Station is now fully investigating the said shootout and looking for possible angles of the crime incident for the part of the civilian and part of the police manning the checkpoint to come up with a positive and responsible results.


“We are now conducting a full investigation of the case, but surely there will be no whitewash on who shoot who and who’s to be blame”. PC/INSP Gunao said.


While, PNP Provincial Director P/SSUPT Ochotorena said that his command will follow all the laws, all the rules, and on anything that can serve justice to the victim.


“Our police have been conducting this checkpoint because of our campaign against loose firearms, and other lawless activities particularly that the place (Labangan) is reportedly rampant in illegal drugs trading. We are also coordinating with the Army’s premier division, when lately, two military detachment had been also harassed and fired by RPG’s by SPT’s(Southern Philippines Terrorists), but rest assured that justice will be serve, especially to the 16 year old victim. But we will still be filing appropriate charges against the suspect in the checkpoint shootout.” He said.
